Tim Langdell's 'Edge' trademark revoked - Develop

Legal saga comes to an end two years after Mobigames and EA cases

The US Patent and Trademarks department has finally removed the 'Edge' from Tim Langdell's trademark bullying scheme.

Two and a half years after a U.S. District Court Judge ruled they were no longer valid, Commissioner for Trademarks Deborah S. Cohn signed a legal notice canceling the trademarks on the phrases ?The Edge?, ?Edge, ?Cutting Edge?, and ?Gamer's Edge?.

Langdell is known for using these trademarks to file suits against any video game related company that used any of these phrases, including Mobigame, Namco, Sony, Future Publishing, and Marvel Entertainment.

His attempt to sue EA over the title of the first-person free-runner Mirror's Edge proved disastrous for Langdell when the judge found his evidence to be fraudulent and declared his trademarks invalid.

Dozens die, hundreds hurt in Iran earthquake

TEHRAN, Iran (AP) ? A 6.1 magnitude earthquake killed at least 37 and injured hundreds more in a sparsely populated area in southern Iran on Tuesday, Iranian officials said, adding that it did not damage a nuclear plant in the region.

The report said the earthquake struck the town of Kaki some 96 kilometers (60 miles) southeast of Bushehr, a town on the Persian Gulf that is home of Iran's first nuclear power plant, built with Russian help.

"No damage was done to Bushehr power plant," Bushehr provincial governor Fereidoun Hasanvand told state TV. He said 37 people had died so far and 850 were injured, including 100 who were hospitalized.

The plant's chief, Mahmoud Jafari, confirmed the site's condition to semi-official Mehr news agency, saying that it is resistant to earthquakes of up to magnitude eight.

Water and electricity were cut to many residents, said Ebrahim Darvishi, governor of the worst-hit district Shonbeh.

The UN's nuclear watchdog agency said on its website that it had been informed by Iran that there was no damage to the plant and no radioactive release and, based on its analysis of the earthquake, was not seeking additional information. The International Atomic Energy Agency statement indicated that it was satisfied there was little danger.

Shahpour Rostami, the deputy governor of Bushehr province, told state TV that rescue teams have been deployed to Shonbeh.

Three helicopters were sent to survey the damaged area before sunset, said Mohammad Mozaffar, the head of Iran's Red Crescent rescue department. He said damage was particularly bad in the village of Baghan.

Kaki resident Mondani Hosseini told The Associated Press that people had run out into the streets out of fear.

Dozens of aftershocks have been reported by the official IRNA news agency since the earthquake, which occurred at 16:22 local time, 11:58 GMT.

Iran announced three days of mourning.

The quake was felt across the Gulf in Bahrain, the United Arab Emirates and Qatar, where workers were evacuated from high-rise buildings as a precaution.

Earlier on Sunday a lighter earthquake jolted the nearby area. Iran is located on seismic faults and it experiences frequent earthquakes.

In 2003, some 26,000 people were killed by a 6.6 magnitude quake that flattened the historic southeastern city of Bam.

In Russia, the head of the state agency responsible for the Bushehr project said the reactor was not producing fission by chain reaction when the tremor occurred.

"Personnel at the station are continuing to work in a normal regime, the radiation conditions are within the norms of natural background," Igor Mezenin was quoted as saying by the ITAR-Tass news agency.

Russian vote watchdog among thousands of NGOs facing fines, closure

By Alissa de Carbonnel

MOSCOW (Reuters) - Russian's main independent election watchdog and thousands of other non-governmental groups face fines or closure, the justice ministry said on Tuesday, in what activists call a campaign to silence criticism of President Vladimir Putin by rights groups.

He has dismissed criticism of a recent wave of inspections of non-governmental organizations that have caused concern in the West. Putin has described the checks as "routine measures... to bring the activities of organizations in line with the law".

Rights groups say the searches by officials as diverse as prosecutors, tax inspectors, the federal migration services and fire-safety officers are intended to scare them into registering under a new law as "foreign agents" - a term they say echoes Cold War-era espionage and would undermine their credibility.

The Justice Ministry published a report on its website saying it has asked courts to close or suspend the work of nearly 9,000 NGOs, and that another 5,610 face fines.

The ministry singled out vote-monitoring organization Golos in a separate statement, saying it was taking the group to court because it had failed to register as a foreign agent.

Critics of Putin said Golos was targeted because of its role in reporting widespread allegations of vote fraud in a March 2012 presidential election and a December 2011 parliamentary vote.

Evidence reported by Golos helped fuel a wave of big opposition street protest against Putin's 13-year dominance of politics last winter in Moscow and other cities.

The ministry said Golos "receives foreign funding and engages in political activity in Russia, i.e., it functions as a foreign agent" and was in breach of the law by refusing to register - an accusation Golos denied.

DENIAL OF FOREIGN FUNDING

The group says it has not received any foreign grants since the legislation, which applies to foreign-funded NGOs who engage in political activity, came into force in November and vowed to fight the case in court.

"It's a sign that without a doubt there has been a political order against Golos," Grigory Melkonyants, deputy head of Golos, told Reuters. "These fines and made-up charges are part of a campaign to discredit and put pressure on Russian NGOs."

The penalty if a Russian court finds Golos in breach of the new law is a fine of up to 500,000 roubles ($16,000) for the group and up to 300,000 roubles ($9,600) for its director.

Most of the NGOs targeted say they are not involved in politics and are acting in Russia's interests, not against them.

Leading advocacy groups Human Rights Watch and Amnesty International are among those who have boycotted the new law and whose offices have been searched, alarming the West.

The United States has characterized the inspections as "some kind of a witch-hunt". The European Union has called them part of a deeply troubling trend that included laws curtailing freedoms and allowing prosecution of activists.

Pavel Chikov, head of legal-aid group Agora, said most of the 8,916 NGOs that may be shut or suspended are lesser-known NGOs in breach of rules on reporting on their activity.

Putin, after returning to the Kremlin in May, has said the tighter controls on NGOs are needed to stop foreign meddling in Russian affairs and attempts to foment unrest.

"These organizations are engaged in internal political activity. Should our society not be informed of who gets this money and for what purposes?" he said in an interview with German public broadcaster ARD last week.

But civic rights groups who have boycotted the new law say it is vaguely worded to allow arbitrary application for political ends and echoes Stalin-era political repression.

Pork found in Ikea's moose lasagna

STOCKHOLM (AP) ? Ikea says it has withdrawn 17,000 portions of moose lasagna from its home furnishings stores in Europe after traces of pork were found in a batch tested in Belgium.

Ikea spokeswoman Tina Kardum said the product had only been on sale for a month when it was pulled off the shelves on March 22.

The company didn't announce the withdrawal publicly until Swedish newspaper Svenska Dagbladet wrote about it Saturday.

Kardum said the company found out Friday that a follow-up test in Belgium confirmed the lasagna contained 1.6 percent pork.

"We have more information now. That's why we choose to inform now," Kardum said.

Moose meat is common in Sweden though it's not typically used in lasagna.

Ikea has previously recalled meatballs and other meat products sold in its cafeterias and frozen foods sections after tests showed they contained traces of horsemeat.

The Swedish furniture giant is one of many European companies caught up in a scandal over mislabeled meat in frozen food products.

Ikea's withdrawn products came from a Swedish frozen foods maker, which in turn blamed the mislabeling on its meat suppliers.

China asks N. Korea to keep diplomats safe

By Ben Blanchard and Jane Chung

BEIJING/SEOUL (Reuters) - China deplored rising tension on the Korean peninsula on Sunday but said its embassy was operating normally in the North Korean capital and it asked authorities there to ensure its diplomats and other citizens were kept safe.

North Korea, angry about new U.N. sanctions imposed for its third nuclear weapon test in February, has made increasingly strident warnings of an imminent war with South Korea and the United States.

The United States, keen to avoid action that could provoke the North, on Saturday postponed a long-scheduled missile test in California.

The North told diplomats on Friday to consider leaving Pyongyang because of the tension, but diplomatic missions appeared to view the appeal as more rhetoric and staff have stayed put.

South Korea said it was ready to counter any move, including a missile launch, that the North's unpredictable leaders might make.

China is reclusive North Korea's sole major diplomatic and financial backer, but its official statements have reflected an increasing impatience with the action of North Korean authorities under 30-year-old leader Kim Jong-un.

"At present, tensions on the Korean peninsula are rising unceasingly, and China expresses grave concern about this," China's Foreign Ministry said in a statement on its website (www.mfa.gov.cn).

China, it said, had asked North Korea "to earnestly ensure the safety of Chinese diplomats in North Korea, in accordance with the Vienna Convention and international laws and norms".

The ministry said China's embassy was "understood" to be operating normally in Pyongyang. China would "protect the legal rights and safety of Chinese citizens and Chinese-invested organizations in North Korea". It did not elaborate.

Chinese President Xi Jinping, addressing a forum on the southern island of Hainan, appeared to refer to the tension when he said no country "should be allowed to throw a region and even the whole world into chaos for selfish gain".

Stability in Asia, he said, "now faces new challenges, as hot spot issues keep emerging and both traditional and non-traditional security threats exist".

Australian Prime Minister Julia Gillard told the same forum that avoiding conflict on the Korean peninsula was vital.

"There, any aggression is a threat to the interests of every country in the region," she said.

"I do welcome the growing co-operation of all regional governments to prevent conflict on the Korean peninsula and to counter North Korean aggression ... Asia must be a region of sustainable security in which habits of co-operation are the norm."

In Washington, a defense official said a test of the Minuteman III intercontinental missile, scheduled to take place at the Vandenberg Air Force Base in California, would be postponed.

"This is the logical, prudent and responsible course of action to take," the official said, speaking on condition of anonymity.

He said the test had been unconnected to "anything related to North Korea" and added that another test launch could be expected next month. The United States remained fully prepared to respond to any North Korean threat, the official said.

MISSILE LAUNCH "COULD OCCUR"

The South Korean president's office said the country had a "firm military readiness" for any eventuality. It described as "planned behavior" the North's call for South Korean workers to leave the Kaesong joint industrial park, just inside North Korea, and for diplomats to evacuate Pyongyang by April 10.

"Ahead of that time, a situation like a North Korean missile launch could occur," Kim Haing, a spokeswoman for the presidential Blue House, quoted the chief of the National Security office as saying.

"As of now, there are no signs of all-out war, but if a local conflict breaks out, North Korea should be aware that it will pay the price."

Kim Jong-un is the third member of his dynasty to rule North Korea. He took over in December 2011 after the death of his father, Kim Jong-il, who staged confrontations with South Korea and the United States throughout his 17-year rule.

North Korean anger over the sanctions following its nuclear weapon test has been compounded by joint U.S.-South Korean military exercises that began on March 1.

The North has always condemned the exercises but it has been especially vitriolic this year as the United States dispatched B-2 bombers from their home bases to stage mock runs.

North Korean television provided little evidence of tension on Sunday, with newscasts showing old footage of Kim visiting military units. Nor was there any tension in Seoul, with residents strolling in the city centre on a chilly spring day.

South Korean media said on Friday the North had moved two medium-range missiles to the country's east coast, but there has been no confirmation of such a move. That prompted the White House to say that Washington would "not be surprised" if the North staged another missile test.

North Korea has not shut down a symbol of cooperation with the South, the Kaesong industrial zone. But last week, it prevented South Koreans from entering the complex and 94 returned home on Saturday, the Unification Ministry said, leaving a further 518 there.

Cats compete in Hallmark Channel's 'Kitten Bowl'

NEW YORK (AP) ? The rivalry on Super Bowl Sunday is already shaping up as a battle between puppies and kittens.

Hallmark Channel says it's introducing an annual "Kitten Bowl" on Feb. 2. It's a three-hour showcase of feline agility, but the network says any form of cuteness is key to the game.

Cat contenders will be recruited from animal shelters. The prize will be a loving home for these orphans.

"Kitten Bowl," produced in partnership with the American Humane Association, will be vying for viewers with Animal Planet's 10th annual "Puppy Bowl," which features its own "Kitty Half-Time Show."

Hallmark's "Kitten Bowl" will air at 12 noon Eastern time, then encore twice immediately after.

Of course, viewers who don't care about puppies or kitties won't be forgotten. There'll be football on another channel.

CHART OF THE DAY: Time Spent On Facebook - Business Insider

There is, and probably always will be, a story floating the ether that Facebook is getting smoked by up and coming rivals like SnapChat, Whatsapp, or Twitter.

While those services are certainly popular, they're not hurting Facebook, according to comScore data analyzed by J.P. Morgan analyst Doug Anmuth. Anmuth notes that Facebook's share of total mobile minutes continues to rise, while share of time spent on those other sites remains relatively flat.

Though, as Peter Kafka at All Things D notes, Anmuth isn't looking at demographic data. Most of the concern about Facebook is that it's lost its edge with teens. If that's true, it will show up in the data soon enough.

Arizona tribe seeks artifacts up for auction

FLAGSTAFF, Ariz. (AP) ? An Arizona tribe is asking a Paris auction house to cancel its upcoming sale of dozens of items central to the tribe's religious practices and return them to their original homes in the American Southwest.

Neret-Minet Tessier & Sarrou describes the collection on its website as katsina masks of the Hopi Indians of Arizona. They are scheduled to be auctioned April 12, with some expected to garner tens of thousands of dollars each.

To the Hopis, they are living beings called katsina friends that emerge from the earth and sky to connect people to the spiritual world and their ancestors. Every member of the Hopi Tribe gets initiated into the Katsina society as a rite of passage.

Leigh Kuwanwisiwma, director of the tribe's cultural preservation office, said the religious items have no commercial value and should be in the hands of the American Indian tribes from which they were taken, including the pueblos of Jemez, Acoma and Zuni in New Mexico. The sale of such items isn't extraordinary, but the size of the collection to be auctioned in Paris and the age of the items is, he said.

The majority of the 70 katsina friends are labeled as Hopi and date back to the late 19th century and early 20th century. Kuwanwisiwma said they likely were collected from the Hopi in the 1930s and 1940s when there was documented evidence of a French citizen on the northern Arizona reservation.

"A lot of these objects were collected under suspicious conditions," he said. "You had such a huge competition by museums to collect artifacts from tribal reservations, and Hopi was no exception."

Acoma Pueblo said Wednesday that it would look into whether a piece labeled as originating from Acoma is authentic and would support any efforts to repatriate American Indian artifacts.

The Native American Graves Protection and Repatriation Act gives federally recognized American Indian tribes a way to reclaim funerary objects and ceremonial items from federal agencies and museums in the United States. Sherry Hutt, the program manager for the national NAGPRA office under the U.S. Department of the Interior said the law doesn't always apply to items held internationally.

"Did it leave at the time by gift or was it removed without permission? What were the rules at the time?" she said. "Once you know that, you may or may not have an application of NAGPRA, you may or may not have statues that apply to cultural resources or other remedies, generally."

An email sent to Neret-Minet Tessier & Sarrou on Tuesday was not returned, and the auction house declined immediate comment when contacted by a reporter on Wednesday. The press release announcing the auction said the items were collected by a "connoisseur with peerless taste," who had lived in the United States for more than 30 years and had attended katsina dances at the Hopi villages but doesn't say how.

Jose Viarreal, editor of the website artdaily.org, published the news release and said he received calls afterward from Hopis furious about the sale. He said he contacted the auction house and was told the items were obtained legally.

"I think this is going to go through as planned," he said.

Kuwanwisiwma said no Hopi has authority to sell or transfer such items because they are considered cultural patrimony, and no one other than a Hopi tribal member should possess them. Things haven't always worked out that way.

The Heard Museum in Phoenix is backing the Hopi Tribe's effort to recover the items and said it was hopeful the U.N. Declaration on the Rights of Indigenous People could be used as leverage. France was among the first to sign the declaration that says indigenous people have the right to repatriation of their human remains, ceremonial objects and cultural patrimony.

The auction house cited a book written by the founder of the Museum of Northern Arizona in its description of the katsinas, which Hopi artists commonly depict in carved, wooden figures and sell. The museum's director, Robert Breunig, appealed to the sense of decency and humanity in asking that the auction be called off.

"To be displayed disembodied in your catalog and on the Internet is sacrilegious and offensive," he wrote in a letter to the auction house. "If one claims to value these katsina friends as 'works of art,' one must also respect the people who made them and the native traditions that govern their use."

If returned, Kuwanwisiwma said the items will be placed in the care of the head katsina priest. The tribe would not bid on the objects otherwise, he said.

"Culturally we made it clear that there's no price tag on our ceremonial and religious objects," he said. "That's pretty much out of the question."

Crucial step in human DNA replication observed for the first time

Tuesday, April 2, 2013

For the first time, an elusive step in the process of human DNA replication has been demystified by scientists at Penn State University. According to senior author Stephen J. Benkovic, an Evan Pugh Professor of Chemistry and Holder of the Eberly Family Chair in Chemistry at Penn State, the scientists "discovered how a key step in human DNA replication is performed." The results of the research will be published in the journal eLife on 2 April 2013.

Part of the DNA replication process -- in humans and in other life forms -- involves loading of molecular structures called sliding clamps onto DNA. This crucial step in DNA replication had remained somewhat mysterious and had not been well studied in human DNA replication. Mark Hedglin, a post-doctoral researcher in Penn State's Department of Chemistry and a member of Benkovic's team, explained that the sliding clamp is a ring-shaped protein that acts to encircle the DNA strand, latching around it like a watch band. The sliding clamp then serves to anchor special enzymes called polymerases to the DNA, ensuring efficient copying of the genetic material. "Without a sliding clamp, polymerases can copy very few bases -- the molecular 'letters' that make up the code of DNA -- at a time. But the clamp helps the polymerase to stay in place, allowing it to copy thousands of bases before being removed from the strand of DNA," Hedglin said.

Hedglin explained that, due to the closed circular structure of sliding clamps, another necessary step in DNA replication is the presence of a "clamp loader," which acts to latch and unlatch the sliding clamps at key stages during the process. "The big unknown has always been how the sliding clamp and the clamp loader interact and the timing of latching and unlatching of the clamp from the DNA," said Hedglin. "We know that polymerases and clamp loaders can't bind the sliding clamp at the same time, so the hypothesis was that clamp loaders latched sliding clamps onto DNA, then left for some time during DNA replication, returning only to unlatch the clamps after the polymerase left so they could be recycled for further use."

To test this hypothesis, the team of researchers used a method called F?rster resonance energy transfer (FRET), a technique of attaching fluorescent "tags" to human proteins and sections of DNA in order to monitor the interactions between them. "With these tags in place, we then observed the formation of holoenzymes -- the active form of the polymerase involved in DNA replication, which consists of the polymerase itself along with any accessory factors that optimize its activity," Hedglin said. "We found that whenever a sliding clamp is loaded onto a DNA template in the absence of polymerase, the clamp loader quickly removed the clamp so that free clamps did not build up on the DNA. However, whenever a polymerase was present, it captured the sliding clamp and the clamp loader then dissociated from the DNA strand."

The team members also found that, during the moments when both the clamp loader and the clamp were bound to the DNA, they were not intimately engaged with each other. Rather, the clamp loader released the closed clamp onto the DNA, allowing an opportunity for the polymerase to capture the clamp, completing the assembly of the holoenzyme. Subsequently, the clamp loader dissociated from DNA. "Our research demonstrates that the DNA polymerase holoenzyme in humans consists of only a clamp and a DNA polymerase. The clamp loader is not part of it. It disengages from the DNA after the polymerase binds the clamp," Hedglin added.

Benkovic noted that this mechanism provides a means for the cell to recycle scarce clamps when they are not in use for productive replication.
